The following declarations inform users of the nature, extent and purpose of the collection and use of personal data on the website www.fsm.de. The service is operated by the Association for Voluntary Self-Regulation of Digital Media Service Providers (FSM e. V.), Beuthstr. 6, 10117 Berlin, office(at)fsm.de, Tel. +49 (0)30 24048430. These data protection declarations do not apply to other websites, products and online or offline services of the FSM with the exception of paragraph 9. In accessing this website you are expressing your approval of the practices of data collection described in the following declarations.

2. Access data

Together with the Internet protocol address through which you are accessing the Internet, the website can record certain information concerning your visit, e.g. date and duration, the pages that you access and the Internet addresses of websites from which you have arrived at our website. This information will be used for the operation and improvement of the website and for statistical evaluation.

3. Website analysis

This website uses the web analytics tool of “Matomo” (formerly “Piwik”). The version we use works with anonymization of IP addresses ensuring that no concrete personal data can be identified. For more information, please visit https://matomo.org/.

4. Use of cookies

We use cookies on this website to adjust its behaviour to meet your personal needs. A cookie is a small text file which is placed by a server on your hard disk. Cookies cannot be used to run programmes or to send viruses to your computer. Cookies are solely allocated to your use and can be read only by a web server in the domain which made the cookie available to you. You have the opportunity to accept or refuse cookies. Most web browsers accept cookies automatically, but you can normally change your browser settings so that cookies will be rejected if you wish. 5. Newsletter and e-mail marketing

Through our newsletter, we inform you about news in the field of youth media protection. You can subscribe to our newsletter through a double-opt-in method. If you want to subscribe to the newsletter, we will need a valid e-mail address as well as information which allow us to confirm that you are the owner of the provided e-mail address or the owner agrees to receive the newsletter. Further personal data we register can be your name and gender. These data are solely used to dispatch the newsletter and will not be shared with third parties. When subscribing to the newsletter we store your IP address and the date of subscription. Storing this data will only be used for verification in the case of third parties abusing the e-mail address or subscribing to the newsletter without the knowledge of the entitled person. No further data is collected. You can revoke your agreement to the storage of the data, the e-mail address and its use in dispatching the newsletter at any time by using a link provided in every newsletter or by sending a message using the contact facilities displayed above. Data is not processed in a way which would allow personal references while we reserve the right to statistically evaluate anonymous data records.

6. Contacting us

When contact is made with the FSM, for example, by e-mail, the information given by the user will be stored for purposes of processing the enquiry and in case further questions arise.

7. Complaints

The FSM treats personal information related to the reporting person as strictly confidential. Such information will be processed electronically and deleted upon the end of the complaints procedure.

8. Embedded YouTube videos

YouTube videos are embedded on the website using the expanded data protection mode. When embedding the videos requests to YouTube servers are made due to technical reasons. 9. Social Media

The FSM provides the following channels on social networks and platforms: Facebook , LinkedIn, X (formerly Twitter) and YouTube. We would like to point out that personal data of users may be processed outside of the European Union as well as for purposes of market research and advertising and by the aforementioned social networks and platforms.

10. Processing of personal data

The FSM will record, make use of and disclose personal data of the user only when legally permitted or the user has agreed to the processing of the data. Personal data will be processed solely as described in sections 2 to 9 (see above). Personal data may be published, according to legal requirements or as matters of good faith, in order (a) to comply with statutory regulations or legal actions imposed on the FSM; (b) to protect and defend the rights or the property of the partners and of our website; or (c) in cases of emergency, to take action to protect the personal security of our employees or representatives, the users of our products and services, or of the general public. The legal basis for data protection is to be found in the General Data Protection Regulation (GDPR), German Federal Data Protection Act (BDSG) and the German Telemedia Act (TMG).

11. Information, correction, deletion, restriction of the processing and revocation of your data

Every user has the right, on application, to receive information free of charge concerning their personal data which is being stored. In addition, the user has the right to demand the correction of inaccurate data, provided there is no legal obligation to retain them. 12. Amendments to the data privacy statement

It is possible we may occasionally change these declarations on data protection. If this is the case, we will also add the date of the “latest amendment“ to the declarations below. In the event of significant alterations in these declarations we will inform you, either by displaying a conspicuous message on the homepage of our website or by sending you direct notification. We encourage you to read these data protection declarations at regular intervals to keep informed about how we help to protect the personal data which we store about you.
